I can't speak to the specifics (and wouldn't even if I had knowledge) but it doesn't necessarily surprise me when experienced lawyers end up on these lists for non-fraud matters.

It takes a lot of energy, both physically and emotionally to do what we do. Sometimes you either run out of gas, or you just can't handle the same load of files you used to for other reasons. You might be used to a certain income level and don't want to scale your practice back or bring in extra help.

I'm not saying this excuses it, just saying that there are often factors that relate to these things.

For example, earlier this year I had a nasty (but not overly serious) lower back injury. For about six months I couldn't handle the same workload I used to. Fortunately our practice, while not huge, has a number of talented Associates who can pick up the slack. It was mostly seamless for our clients (other than a letter indicating that I'd still be managing their file but attorney X would be handling day-to-day matters).

But if I'd been a sole practitioner struggling under debt (either firm related or maybe just a big mortgage) the situation would have been much more difficult for my clients and for me.

Similarly, burnout can be a real issue. I've seen experienced lawyers struggle with it and sometimes, they might not be aware they're struggling.
