This wasn't a soldier on a battlefield.  This was the assasination of an asshole who preached violence.  He wasn't a soldier, he wasn't a commander, he wasn't on a battlefield, and he wasn't taking active part in hostilities.  You can pretend that being a bad guy means that he was, but the reality is that he wasn't.

He was taking part in hostilities by commanding them.  So yes, he was engaged in battle.  It's no different than targetting the commander of an enemy army, which is allowed.
