This wasn't a soldier on a battlefield.  This was the assasination of an asshole who preached violence. 

And before someone comes along to pretend that was sufficient reason to kill him, the SCOTUS ruled in the trial of another asshole that violent sermons are protected speech under the 1st Amendment.
